Definitions of Minor and Guardian Unofficial title
Proposal (not yet law)
This is the text proposed by the European Commission on 17 September 2026 (COM(2026) 681 final, procedure 2026/0286(COD)). It has not been adopted and has no legal effect. The European Parliament and the Council may amend it, so the final wording and numbering may differ. Follow the procedure on EUR-Lex.
For the purposes of this Regulation, it is appropriate to establish a common definition of a minor or child. A 'minor’ or ‘child’ should be understood as any natural person under the age of 18, irrespective of any provisions of national law providing for an earlier or later attainment of legal majority. Furthermore, while providers of online social networking services, of video-sharing platform services, online games, software application stores and AI systems remain primarily responsible for the safety of their services and systems when used by minors, parents and legal guardians can play a role in guiding the minors’ experience online. The notion of guardian for the purpose of this Regulation should be based on the definition of parental responsibility in Council Regulation (EU) 2019/1111(6).
