Interplay with Article 28(1) of the Digital Services Act Unofficial title

This is the text proposed by the European Commission on 17 September 2026 (COM(2026) 681 final, procedure 2026/0286(COD)). It has not been adopted and has no legal effect. Where providers of services falling within the scope of this Regulation are also subject to the obligation to ensure a high level of privacy, safety and security pursuant to Article 28(1) of Regulation (EU) 2022/2065, these obligations are specified for the subject matters covered in this Regulation. Compliance with the obligations set out in this Regulation should however not be construed sufficient in itself to constitute proof of compliance of such providers with Article 28(1) of Regulation 2022/2065 and should therefore be without prejudice to further mitigation measures which such providers may be required to put in place for matters not covered by this Regulation for example those related to ensuring security. Equally, Article 28(1) of Regulation (EU) 2022/2065 should remain applicable to online platforms outside of the scope of this Regulation.
